The Cleanup Plan describes various remedial assessments <br /> conducted at the site and the surrounding Port of Stockton petroleum sites since 1994, and the <br /> nitrate application pilot study conducted at the site in 2003 and 2004. KMEP proposes <br /> monitored natural attenuation (NINA) for cleanup of the site. <br /> The Cleanup Plan lists remedial action objectives (RAO) of continued destruction of petroleum <br /> hydrocarbons in groundwater by the process of intrinsic bioremediation and to prevent the <br /> accumulation of free product and further degradation of groundwater quality, which are designed <br /> "to be protective of the current beneficial use of groundwater." This is not acceptable. The RAO <br /> is to remove all pollutants originating from the site from groundwater and from soil as <br /> technically and economically feasible such that pollutant levels in groundwater are at background <br /> or non-detectable levels or if not feasible, not to exceed water quality objectives. <br /> Regional Board staff concurs with the Cleanup Plan provided that by 15 April 2005, KMEP <br /> provides written acknowledgment of the RAO to remove all pollutants from soil and <br /> groundwater that originate from the site as stated above. Based on the stability of the <br /> hydrocarbon plume, results of MNA monitoring, existing and surrounding land use, and the <br /> proposed contingency plan if plume characteristics or land use change, MNA should be an <br /> effective remedial alternative. If the hydrocarbon plume migrates or concentrations increase, <br /> KMEP will need to re-evaluate remedial alternatives for the site. <br /> Since the groundwater cleanup is an action to assure the restoration of the environment, they are <br /> exempt from the provisions of the California Environmental Quality Act (Public Resources <br /> Code, Section 21000, et seq.), in accordance with Sections 15308 and 15330, Title 14, California <br /> Code of Regulations.
