("Property Owner") <br /> with a mailing addresses of 301 E. Miner Avenue, Stockton, California, and LFR Inc. ( "the <br /> Permittee")with a mailing address of 1900 Powell Street 12°i Floor,Emeryville,California on behalf <br /> of the Lincoln Center Environmental Remediation Trust("the Trust")with a mailing address of 137 <br /> Park Place, Point Richmond, California 94801,in connection the prop located at 6808 Pacific <br /> Avenue =-' �x7 ae-j--:- ** 7 *� ' in Stockton California ('W1�Subject Properto"). The <br /> Permittee requests access to the Subject Proper r' to complete the field activities("Field Activities") <br /> detailed below. <br /> 1. Grant of Access. The Property Owner hereby grants permission to the Permittee and its <br /> subcontractors to access the Subject Properties to perform the Field Activities, subject to the <br /> terms and conditions set forth in this Agreement. <br /> 2. Permits/Licenses. The Permittee will perform the Field Activities in accordance with all <br /> applicable laws, regulations, ordinances and other rules of the state, territory or political <br /> subdivision where the work is done. The Permittee will procure and maintain necessary permits <br /> or licenses. <br /> 3. Use.Occupation and Eniovment of the Subject Properties Neither the Permittee,the Trust, <br /> or any subcontractor will unreasonably interfere with the Property Owner's use, occupation or <br /> enjoyment of the Subject Property, except as agreed to in writing by the Property Owner. All <br /> work will be performed after business hours (i.e. after 6:00 PM and before 7:00 AM) and will <br /> not be considered to be interference. <br /> 4. Performance of the Field Activities The Field Activities shall be performed in a workmanlike <br /> manner and appurtenances maintained in good condition and repair. Reasonable precautions <br /> shall be taken to minimize damages to the Subject Property from the Field Activities. The <br /> Subject Property shall be restored to its condition existing at the time the Field Activities began <br /> in as much as possible. Assuming that the work is performed in areas of asphaltic pavement,it <br /> is understood that any replacement asphaltic pavement may differ in color from the existing <br /> pavement as it will be new work. <br /> 5. Deserintion of Field Activities As part of the Filed Activities,LFR and its subcontractor will <br /> advance soil borings at the approximate locations shown on Exhibit A.The Field Activities are <br /> being completed under the oversight of the Regional Water Quality Control Board(RWQCB) <br /> and in accordance with LFR's "Work Plan to Conduct a Focused Membrane Interface Probe <br /> Investigation, Lincoln Center, Stockton, California" dated April 27, 2006. The equipment we <br /> will use to perform the investigation is mounted in two mid-sized trucks. The work space <br /> 431267.1 <br />
