CLEANUP AND ABATEMENT ORDER -3- <br /> LINCOLN PROPERTIES, LIMITED <br /> LINCOLN VILLAGE SHOPPING CENTER <br /> SAN JOAQUIN COUNTY <br /> 15. A statewide task force has been proposed to study issues related to <br /> pollution of ground water with PCE which is related to dry cleaning <br /> operations. The task force is expected to consider methods of financing <br /> cleanup of PCE contamination associated with dry cleaning operations. A <br /> decision regarding whether to hold the Dry Cleaners and sewering agencies <br /> responsible for cleanup will be deferred while the proposed task force on <br /> dry cleaning problems performs its study, which is expected to be complete <br /> in December 1992. <br /> 16. The PCE, TCE, DUCE, and DCA has polluted soil and ground water and has <br /> contaminated or threatens to contaminate the municipal supply wells. <br /> 17. Lincoln has always known of the operation of the dry cleaners at the <br /> Shopping Center, and knew or should have known of the hazardous character <br /> of PCE. Lincoln has had sufficient control of the property to prevent or <br /> abate the discharges. Lincoln caused or permitted the PCE discharges to <br /> ground water. <br /> 18. The Board has requested Lincoln to define the vertical and lateral extent <br /> of the polluted ground water and soil . Lincoln has completed Phases I and <br /> II of the site investigation. Since neither phase fully defined the <br /> extent of the pollution, Lincoln will be required to implement Phase III <br /> of the investigation according to a compliance time schedule specified in <br /> this Order. The time schedule also governs the development, implementa- <br /> tion and operation of a cleanup remedy to be chosen through the evaluation <br /> of all potentially effective cleanup options. If Phase III cannot define <br /> the pollution' s extent, Lincoln will be required to continue to investi- <br /> gate until achieving adequate definition. <br /> 19. Lincoln has agreed to comply with this Order which requires Lincoln to <br /> complete the site investigation, evaluate remedial measures and implement <br /> the selected remedy. <br /> 20. On 19 September 1991 , the Board approved the ground water monitoring <br /> program proposed by Lincoln. The approved program requires quarterly <br /> sampling of most of the monitoring wells installed in Phases I and II and <br /> proposed for Phase III of the site investigation. This Order requires the <br /> Lincoln annually to evaluate the monitoring program in light of the <br /> ongoing cleanup and to propose modifying or expanding the program <br /> accordingly. <br /> 21. The beneficial uses of San Joaquin County ground water in this area are <br /> domestic, municipal , and agricultural . <br /> 22. Section 13304(a) of the California Water Code provides in part that, <br /> "Any person who has discharged or discharges waste into the waters of the state in violation of any <br /> waste discharge requirement or other order or prohibition issued by the regional board or the state <br />
