The investigation has <br /> determined that a groundwater plume of PCE extends east of Lincoln Center and underlies your <br /> property at 6632 Pacific Avenue. On 30 March 1998, LFR sent you a letter explaining the nature <br /> of the investigation and requesting access to the parking lot at 6632 Pacific Avenue to locate an <br /> abandoned well. Your 3 April 1998 response denied LFR access to conduct this investigation. <br /> The abandoned well was apparently part of the former Safeway operations. According to <br /> Safeway, the well was abandohed in 1971 or 1972 when the previous Safeway building was <br /> demolished and the present building constructed. Safeway cannot provide any specifics on the <br /> method of well abandonment. Since this well extended to a depth of 240 feet, improper <br /> abandonment could allow the shallow PCE-contaminated groundwater to move downward into <br /> the regional aquifer which is used for drinking water supply. Therefore, it is critical that an <br /> investigation be done to locate this well and abandon it properly, if necessary. <br /> Under the California Water Code Sections 13267 and 13304, all persons owning property <br /> underlain by contaminated groundwater may be held responsible for investigation and <br /> remediation of the contamination. Generally, the Board has exercised its discretion to hold <br /> responsible only persons who own the land which was the source of pollution, and not <br /> landowners whose land sits over the plume. Nonetheless, it is common that those persons <br /> remediating sites require access to adjacent land to complete their investigation and remediation. <br /> Recycled Paper Our mission is to preserve and enhance the quality of California's water resources,and <br /> ensure their proper allocation and efficient use far the benefit of present and future generations. <br />
