<br /> Where access to adjacent land is required, the Board encourages the responsible party and the
<br /> adjacent landowners to come to agreement regarding access. This agreement may include
<br /> indemnity clauses and payments. We have received a letter from SDCDs' attorney, Mr. John J.
<br /> Gregory of LeBoeuf, Lamb, Green & MacRae, L.L.P., indicating that LFR has been requested to
<br /> refrain from contacting you further. We are concerned that the failure to reach agreement will
<br /> impede the Lincoln Village Center groundwater investigation and may cause a spreading of the
<br /> PCE contamination.
<br /> We wish to state emphatically that the investigation to locate and properly abandon this well
<br /> must proceed, and that, while we prefer to see the parties come to an agreement on access, we
<br /> will intervene if necessary. We suggest that you and SDCDs make all attempts to reach a
<br /> successful conclusion, and we are willing to meet with you in an effort to reach agreement.
<br /> However, if there is no agreement and the investigation is delayed, we will consider issuing
<br /> orders for the investigation and well abandonment to First Jun Jun Investment, Inc.
