LPL will notify the SDCOs of LPL's intent to increase its level of O&M to fulfill <br /> its 0&M obligations under the Permanent Injunction and the First Final Consent <br /> Decree. <br /> The grant of access contained in this letter is conditioned upon the <br /> understanding that the work to be conducted by the SDCDs and Levine Frike Recon, <br /> Inc., will proceed with all deliberate haste, while simultaneously observing the <br /> requirement contained in the Permanent Injunction and the First Final Consent Decree <br /> that the SDCDs must, to the maximum extent practicable, not interfere with the <br /> operations of Lincoln Center or with the operations of the business of any tenant of <br /> Lincoln Center. <br /> It is noted that the work contemplated in the SDCDs' Site Access Request <br /> referenced above will disrupt and tear up substantial portions of the parking lots in <br /> Lincoln Center North and South adjacent and parallel to the western boundary of <br /> Pacific Avenue. Many of Lincoln Center's main access ways for tenants, patrons, and <br /> suppliers are located off of Pacific Avenue. The SDCDs are urged to be ever mindful of <br /> the impacts that invasive well drilling may have upon the retail businesses, patrons, <br /> and suppliers of Lincoln Center during the pendency of this Phase I IRA project. <br /> In conclusion, LPL is granting the Settling Dry Cleaning Defendants access for <br /> these activities as an accommodation to the Special Master, in spite of the fact that the <br /> Special Master has not determined that the Settling Dry Cleaning Defendants are in full <br /> compliance with the insurance requirements of the Permanent Injunction and the First <br /> Final Consent Decree. In the event that the Special Master determines that additional <br /> or modified insurance is required to satisfy the provisions of the applicable Orders, this <br /> grant of access will be conditioned upon the Settling Dry Cleaning Defendants' making <br /> every effort to have that insurance in place prior to completing the pending work. <br /> Please contact me at (209)472-9200 should you have any questions or concerns <br /> regarding this grant of access. <br /> Sincere , <br /> it ur H.
