CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ORDER NO. R5-2010-0054 <br /> RESCISSION OF CEASE AND DESIST ORDER R5-2004-0004 <br /> FOR WOODBRIDGE PARTNERS, INC., VICTOR FINE FOODS FACILITY, <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, (hereafter <br /> Central Valley Water Board) finds that: <br /> 1. On 29 January 2004, the Central Valley Water Board adopted Cease and Desist Order <br /> (CDO) R5-2004-0004 for the Victor Fine Foods Facility, which is owned by Woodbridge <br /> Partners, Inc., (hereafter Discharger). <br /> 2. The CDO required the Discharger to: <br /> a. Cease and Desist from violating the requirements of Waste Discharge Requirements <br /> Order No. 5-01-057 (Item #1); <br /> b. Submit a plan to clean close Pond 1 in compliance with the requirements of Title 27 <br /> (Item #2); <br /> c. Complete closure of Pond 1 (Item #3); <br /> d. Complete abandonment of the underground injection well in compliance with USEPA <br /> requirements (Item #4); and <br /> e. Submit a technical report assessing the extent of discharge of waste from the site in <br /> groundwater and provide an engineering feasibility study to cleanup the waste (Item <br /> #5). <br /> 3. The Discharger submitted an excavation and grading plan to clean close Pond 1 on <br /> 12 March 2004. In a letter dated 15 April 2004, Central Valley Water Board staff <br /> approved the closure plan. This approval completed Item #2 of the CDO. <br /> 4. In a letter dated 11 April 2007, Central Valley Water Board staff approved the Pond 1 <br /> Closure and Storm Drain Retention Basin Construction, Revision 1: Addition of Closure <br /> Documentation, which was submitted on 13 March 2007. The report documented the <br /> required clean closure of Pond 1 in general conformance with the approved Pond 1 <br /> Closure Plan. This approval completed Item #3 of the CDO. <br /> 5. On 21 April 2008, the Discharger completed the abandonment of the deep injection well in <br /> accordance with USEPA guidelines. Confirmation and closure of the file was received <br /> from the United States Environmental protection Agency (USEPA) in a letter dated <br /> 20 August 2008. The abandonment of the deep injection well completed Item #4 of the <br /> CDO. <br />
