Order No R5-2010-0054 -2- <br /> Rescission of CDO R5-2004-0004 <br /> Victor Fine Foods, San Joaquin County <br /> 6. The Discharger submitted the Engineering Feasibility Study (EFS) Report dated <br /> 5 December 2008. The EFS evaluated the extent of discharged waste and evaluated <br /> options with respect to groundwater cleanup. The EFS Report completed Item #5 of the <br /> CDO. <br /> 7. Therefore, the Discharger has completed all items required under CDO R5-2004-0004. <br /> 8. The Central Valley Water Board has notified the Discharger and interested agencies and <br /> persons of its intent to rescind CDO R5-2004-0004 and has provided them with an <br /> opportunity for a public hearing and an opportunity to submit their written views and <br /> recommendations. <br /> 9. Issuance of this Order is exempt from the provisions of the California Environmental <br /> Quality Act (Public Resources Code, Section 21000, et seq.), in accordance with Section <br /> 15321(a)(2), Title 14, California Code of Regulations. <br /> 10.The Central Valley Water Board, in a public meeting, heard and considered all comments <br /> and evidence pertaining to this matter. <br /> IT IS HEREBY ORDERED that Cease and Desist Order R5-2004-0004 is rescinded. <br /> I, PAMELA C.
