Lockeford Street <br /> 12793 Paddy Creek Lane Lodi, California 95240 <br /> Lodi, California 95240 <br /> PROPOSAL TO RESCIND CEASE AND DESIST ORDER AND NOTICE OF VIOLATION, <br /> FORMER VICTOR FINE FOODS, SAN JOAQUIN COUNTY <br /> Staff of the Central Valley Regional Water Quality Control Board (Central Valley Water Board) <br /> has reviewed your 16 February 2010 letter requesting that Cease and Desist Order (CDO) No. <br /> 135-2004-0004 be rescinded. The Discharger (Woodbridge Partners, Inc.) was required to <br /> complete Items a through a of the CDO and staff concurs these items have been completed. <br /> Staff will submit a request to the Water Board to rescind CDO No. R5-2004-0004 at the May <br /> 2010 Board meeting. <br /> However, a review of the case file shows that the Discharger has not submitted groundwater <br /> monitoring reports as required by Waste Discharge Requirements (WDRs) Order No. <br /> 5-01-057 since 2nd Half 2006. The failure to submit monitoring reports is a violation of the <br /> WDRs. Even though the work required by the CDO has been completed, staff continues to <br /> have concerns about groundwater quality offsite and it is appropriate to continue monitoring <br /> the wells, both to comply with the WDRs and to determine current conditions. <br /> The figures presented in the Engineering Feasibility Study dated 5 December 2008, and <br /> attached to the 16 February 2010 letter, indicate the salt plume has migrated beyond the <br /> furthest perimeter well MW-2. Concentrations at well MW-2 are reported to be approximately <br /> 1200 mg/L in December 2006. Without current data, staff can not effectively evaluate <br /> conditions of the groundwater plume and whether the corrective actions conducted to date are <br /> working to clean up the underlying contamination. <br /> Woodbridge Partners, Inc., must comply with the WDRs and associated monitoring and <br /> Reporting Program (MRP). A copy of the Order is enclosed for your information. As required <br /> by the Order, you shall provide groundwater monitoring data and reports beginning with the <br /> second quarter 2010 and semi-annually thereafter. The monitoring reports are due the 15th <br /> day of the month following the calendar quarter in which samples were taken.
