,
3978 S. Hwy 99, Stockton .
Page 2
The current property owners of this site are not eligible for reimbursement of corrective action
costs from the State Water Resources Control Board Cleanup Fund because they never
owned or operated UST's at this site. Chevron/Texaco as the owner/operator of the UST's
would meet the eligible applicant definition for the Cleanup Fund. The current property
owners have conducted the initial site investigation and groundwater monitoring well
installation. The current property owners have not complied with EH D's February 8, 2007,
and May 9, 2007, directives to submit a work plan to continue the investigation of the lateral
and vertical extent of the contamination,-allegedly because they cannot afford to continue
with the required investigative work.
Although Chevron has stated they cannot accept responsibility for the.contamination, EHD
considers the information provided to date supports the identification of Chevron/Texaco as a
responsible party (owner/operator of UST's immediately before discontinuation of their use).
Sandra and Romeo Yacoub as property owners are also responsible parties. EHD directs
that a work plan to continue the investigation of the lateral and vertical extent of the
contamination at the site be submitted to EHD by November 15, 2007.
If the investigation and remediation of this site does not continue,. it will be referred to the
Regional Water Quality Control Board (CVRWQCB) for enforcement action.
If you have any questions please contact Lori Duncan at (209) 468-0337.
Donna Heran, REHS, Director
Environmental Health Department .
.Lori Duncan, Senior REHS MargareYLagorio, RE S
LOP/Site Mitigation Unit IV Program Coordinator Unit IV
cc: James Barton, CVRWQCB
Kelly Esters, Property Specialist-, Chevron, 6001 Bollinger Canyon Rd San Ramon
CA 94583
Ort Deicke, AGE
avid Evans, Arcadis-BBL
