Why then would RFS consultant <br /> suggest borings in the vicinity of the aboveground storage tanks which are N.E. of RFS former <br /> underground tanks. Further, the boring maps provided by AGE are less than complete because <br /> there are no contamination contours shown on any map. <br /> Fifth, Olympian has also never received any definitive information on ground water flow and <br /> gradient which we requested from RFS and its consultant. In your letter of February 29, 1996 to <br /> Bruce McCandless of RFS, the last paragraph indicates your required additional information on <br /> these areas as well. In that letter you reference your letter of October 19, 1994 requesting a well <br /> survey be conducted and submitted within the next quarterly report. Obviously, this has not been <br /> done notwithstanding your request was made over 18 months ago. <br /> With this in mind, we question the whole process being carried out by AGE and whether they are <br /> looking for any reason to tie RFS contamination to Jimco or whether they are simply chasing <br /> RFS's plume. <br /> In summary, Olympian and Jimco never denied access to the Olympian site. Olympian simply <br /> asked for the following: that RFS take very step to identify its sources of contamination and <br /> what direction RFS's contamination migrated; and to provide us with well documented data and <br /> a workplan. AGE has provided less than complete reports and as of today we have never <br /> received the workplan associated with Olympians property. AGE has failed to do what was <br /> requested, not only by Olympian but also by the County. <br /> With regard to placing the Olympian site on the San Joaquin County contaminated site list, we <br /> request that you provide,u_s with documentation supporting.your conclusion that the.property.is a <br /> health risk. <br /> Olympian has assiduously complied and will continue to comply with all local, state or federal <br /> rules, regulations and laws. However, we strongly believe that absent any evidence of any <br /> release or any contamination incident on or from our property, there simply is no legal nor <br /> equitable reason.to place our property on your list of contaminated sites. <br />
