We have reviewed the ARARs section of the Draft FS Report and developed the <br /> following comments. Generally, Sharpe has developed an extensive overview of ARARs <br /> which form a good basis for developing remedial objectives. <br /> The enclosed memo is a generic list of Regional Board potential ARARs, which is <br /> being updated to include the California Inland Surface Waters Plan which was <br /> recently adopted. Potential ARARs apply to remedial objectives of ground water <br /> (i .e. , cleanup levels) as well as to treatment and disposal alternatives for <br /> contaminated ground water (i .e. , setting performance standards for disposal to land <br /> or surface water) . The following potential ARARs must be specifically considered in <br /> preparing the Final FS Report and the subsequent remedial design: <br /> 1. Porter-Cologne Water Quality Control Act (Division 7, Water Quality portion of <br /> the Water Code) - This Act provides statutory authority to the State and <br /> Regional Boards for the protection of existing and probable future beneficial <br /> uses of the waters of the state. The Regional Board establishes its water <br /> quality standards primarily in adoption of Water Quality Control Plans and of <br /> waste discharge requirements (WDRs) . Substantive requirements, and in some <br /> cases the administrative requirements of WDRs, must be satisfied. The <br /> Porter-Cologne Water Quality Control Act includes location, action, and chemical <br /> specific ARARs. <br /> 2. Water Quality Control Plan for the Central Valley Regional Water Quality Control <br /> Board (Basin Plan) - The Basin Plan for the Sacramento River Basin identifies <br /> the beneficial uses of particular surface and ground water bodies and water <br /> quality objectives to ensure reasonable protection of beneficial uses. The <br /> Basin Plan has designated all ground water, with only a few exceptions, to have <br /> existing or potential beneficial uses as sources of drinking water. These water <br /> quality objectives consist of narrative and numerical standards to protect <br /> designated beneficial uses. The Basin Plan establishes chemical , action, and <br /> location specific ARARs. <br /> 3. California Inland Surface Waters Plan, adopted by the State Water Resources <br /> Control Board on 11 April 1991 through the authority of section 13170 of the <br /> Water Code to establish water quality standards required by the Federal Clean <br /> Water Act. This Plan establishes or provides procedures for setting effluent <br /> limitations for both health and environmental protection based upon existing <br />
