2. Biennial Report <br /> The Permittee shall comply with the biennial report requirements <br /> as required by 40 CFR 264.75. [40 CFR 264.75) <br /> J. CLOSURE PLAN <br /> 1. Closure Plan and Performance standard <br /> The Permittee shall close the facility in accordance with the <br /> Closure Plan, Section XIII of the Part B Application, as required <br /> by 40 CFR 264.111 and 40 CFR 264.178. [40 CFR 264.111 and 40 CFR <br /> 264.178) <br /> 2. Amendment to Closure Plan <br /> The Permittee shall amend the Closure Plan in accordance with <br /> 40 CFR 264.112(c) whenever necessary. [40 CFR 264.112(c) ) <br /> 3. Notification of Closure <br /> The Permittee shall notify the Director at least forty-five (45) <br /> calendar days prior to the date the facility expects to begin <br /> closure. [40 CFR 264.112(d)] <br /> 4. Time Allowed for Closure <br /> a. Within ninety (90) calendar days after receiving the final <br /> volume of hazardous wastes , the Permittee shall treat or <br /> remove from the site all hazardous waste remaining in <br /> storage in accordance with the Closure Plan, Section XIII of <br /> the Part B Application, as required by 40 CFR 264.113 (a) . <br /> 140 CFR 264.113(a)) <br /> b. The Permittee shall complete facility closure activities in <br /> accordance with the Closure Plan, Section XIII of the Part B <br /> Application, as required by 40 CFR 264.113 (b) , within one <br /> hundred and eighty (180) calendar days after receiving the <br /> final volume of hazardous waste. [40 CFR 264.113(b) ] <br /> 5. Disposal or Decontamination of Equipment, Structures and Soils <br /> At closure, the Permittee shall remove all hazardous wastes and <br /> hazardous waste residues from, and shall decontaminate or <br /> dispose, all facility equipment and structures, in accordance <br /> with the Closure Plan, Section XIII of the Part B Application, as <br /> required by 40 CFR 264.114. [40 CFR 264.114) <br /> 6. Certification of Closure . <br /> When closure is completed, the Permittee shall submit to the <br /> Director , certification both by the Permittee and by an <br /> independent professional engineer registered in California that <br /> the facility has been closed in accordance with the <br /> 22 <br />
