Permittee shall achieve compliance with CERCLA, 42 U. S . C. <br /> Section 9061 et. seq. to satisfy the corrective action <br /> requirements of RCRA Section 3004 (u) and (v) , 42 D . S . C . <br /> Section 6924(u) and (v) , and to meet or exceed all applicable or <br /> relevant and appropriate federal and state laws and regulations, <br /> to the extent required by CERCLA Section 121 , 42 U . S . C . <br /> Section 9621. Therefore, RCRA corrective actions compliance <br /> shall be considered an applicable or relevant and appropriate <br /> requirement to CERCLA Section 121. <br /> 3. If the Director finds that further corrective actions beyond <br /> those provided in this permit are warranted, they shall be <br /> implemented by permit modification pursuant to 40 C.F.R. 270.41. <br /> C. NOTIFICATION REQUIREMENTS FOR AND ASSESSMENT OF NEWLY-IDENTIFIED <br /> SOLID WASTE MANAGEMENT UNITS . <br /> 1. The Permittee shall notify the Director in writing of any <br /> newly-identified SWMUs , at Defense Distribution Region <br /> West--Sharpe Site, discovered during the course of ground-water <br /> monitoring, field investigation, environmental audits or any <br /> other means no later than fifteen (15) calendar days after <br /> discovery. <br /> 2. After such notification, the Director may request, in writing, <br /> that the Permittee prepare a Solid Waste Management Unit (SWMU) <br /> Assessment Plan and a proposed schedule of implementation and <br /> completion of the plan for additional SWMU ( s ) discovered <br /> subsequent to the issuance of this permit. <br /> 3. Within sixty (60) calendar days after receipt of the Director' s <br /> request for a SWMU Assessment Plan, the Permittee shall prepare a <br /> SVM Assessment Plan for determining past and present operations <br /> at the unit, as well as any sampling and analysis of ground <br /> water, land surface and subsurface strata, surface water or air, <br /> as necessary to determine whether a release of hazardous waste <br /> including hazardous constituents from such unit(s) has occurred, <br /> or is likely to occur. The SWMU Assessment Plan must demonstrate <br /> that the sampling and analysis program, if applicable, is capable <br /> of yielding representative samples and must include parameters <br /> sufficient to identify migration of hazardous waste including <br /> hazardous constituents from the newly-discovered SWMU(s) to the <br /> environment. <br /> 4. After the Permittee submits the SWMU Assessment Plan, the <br /> Director shall either approve or disapprove the Plan in writing. <br /> If the Director approves the Plan, the Permittee shall begin to <br /> implement the Plan within thirty (30) calendar days of receiving <br /> such written notification. <br /> If the Director disapproves the Plan, the Director shall either <br /> (1) notify the Permittee in writing of the Plan' s deficiencies <br /> and specify a due date for submittal of a revised Plan, or (2) <br /> 28 <br />
