However, the SSJID Canal was not constructed <br /> as a migration pathway or spawning area for cold water species. As noted previously, <br /> Section 101(a)(2) of the CWA requires that water quality that for the protection and <br /> propagation of fish, shellfish, and wildlife, and for recreation in and on the water be <br /> achieved, whenever attainable. The interim national goal for all waters is to be <br /> `fishable/swinunable'. This Order considers aquatic habitat as an existing beneficial use of <br /> the SSJID Canal. The aquatic habitat designation necessitates that the in-stream dissolved <br /> oxygen concentration be maintained at, or above, 5.0 mg/L (ppm). This approach <br /> recognizes that, if the naturally occurring in-stream dissolved oxygen concentration is <br /> below 5.0 mg/L (ppm), the Discharger is not required to improve the naturally occurring <br /> level. <br /> Previous Order No. 95-258 identified French Camp Slough as the point of compliance for <br /> receiving water limitations (Receiving Water Limitation D.). However, the existing beneficial <br /> uses of the SSJID Canal, as described above, must also be protected and maintained. The SSJID <br /> Canal is at times in continuity with French Camp Slough, which flows to the Delta. This Order <br /> considers limitations necessary for the protection of existing beneficial uses in the SSJID Canal. <br /> French Camp Slough <br /> In reviewing what existing beneficial uses that may apply to French Camp Slough, the Regional <br /> Board has considered the following facts: <br /> a. Domestic, Municipal, and Agricultural Supply <br /> The Regional Board is required to apply the beneficial uses of municipal and domestic <br /> supply to French Camp Slough based on SWRCB Resolution No. 88-63 which was <br /> incorporated into the Basin Plan pursuant to Regional Board Resolution 89-056. In <br /> addition, the SWRCB has issued water rights to existing water users along French Camp <br /> Slough downstream of the discharge for domestic and irrigation uses. As noted above, <br /> municipal and domestic supply are identified as existing beneficial uses of the Delta. <br /> b. Water Contact and Non-Contact Recreation and Esthetic Enjoyment <br /> The Regional Board finds that the discharge flows through residential areas, and there is <br /> ready public access to French Camp Slough. Exclusion of the public is unrealistic and <br /> contact recreational activities currently exist along French Camp Slough, these uses are <br /> likely to increase as the population in the area grows. <br />
