ENFORCEABILITY <br /> 31.1 The Parties agree that: <br /> 31. 1.1 Upon the effective date of this Agreement, any standard, regu- <br /> lation, condition, requirement, or order which has become effective under <br /> CERCLA and is incorporated into this Agreement is enforceable by any person <br /> pursuant to Section 310 of CERCLA, and any violation of such standard, regu- <br /> lation, condition, requirement, or order will be subject to civil penalties <br /> under Sections 310(c) and 109 of CERCLA, 42 U.S.C. 9609; <br /> 31. 1.2 All timetables and deadlines associated with the RI/FS shall be <br /> enforceable by any person pursuant to Section 310 of CERCLA, and any viola- <br /> tion of such timetables or deadlines will be subject to civil penalties <br /> under Sections 310(c) and 109 of CERCLA; <br /> 31.1.3 All terms and conditions of this Agreement which relate to <br /> remedial actions, including corresponding timetables, deadlines, or schedu- <br /> le, , and all work associated with the remedial actions, shall be enforceable <br /> by any person pursuant to Section 310(c) of CERCLA, and any violation of <br /> such terms or conditions will be subject to civil penalties under Sections <br /> 310(c) and 109 of CERCLA; and, <br /> 31.1.4 Any final resolution of a dispute pursuant to Section 13, <br /> Resolution of Disputes, which establishes a term, condition, timetable, <br /> deadline, or schedule shall be enforceable by any person pursuant to Section <br /> -47- <br />
