• <br /> activities and elements of work undertaken by SHAD. SHAD agrees to develop <br /> and implement the CRP in a manner consistent with Section 117 of <br /> CERCLA/SARA, 42 U.S.C. 9617, applicable community relations provisions of <br /> the NCP, and EPA guidelines set forth in the EPA Community Relations <br /> Handbook, and relevant state requirements concerning public participation. <br /> 30.3 Any Party issuing a written press release to the media, including the <br /> SHAD newspaper, regarding any of the work required by this Agreement shall <br /> advise all other Parties of such written press release and the contents <br /> thereof, at least twenty-four (24) hours before the issuance of such press <br /> release and of any subsequent changes prior to release. No Party receiving <br /> a press release under this Subsection will release it to any person until it <br /> is released by the originating Party; provided, nothing herein shall prevent <br /> a Party from disclosing information from a press release where such disclo- <br /> sure is required by the California Safe Drinking Water and Toxic Enforcement <br /> Act of 1986 or where the press release contains information regarding an <br /> imminent or substantial threat to public health or to the environment. <br /> 30.4 SHAD shall establish and maintain two (2) identical administrative <br /> records, one at the Depot, and one at a location near the Depot and conven- <br /> ient to the public, which shall provide the documentation supporting the <br /> selection of each response action in accordance with Section 113(k) of <br /> CERCLA/SARA, 42 U.S.C. 9613(k). The administrative record shall be estab- <br /> lished and maintained in accordance with current and future EPA policies and <br /> guidelines. A copy of each document placed in the administrative record, <br /> not already provided, will be provided to the EPA, DOHS, and RWQCB.
