The Parties wish to avoid the expense of litigation and to ensure prompt <br />compliance with California requirements regarding hazardous materials. <br />5. Jurisdiction over this matter exists pursuant to HSC § 25404.1.1. <br />6. Respondents waive any right to a hearing in this matter. <br />7. This Consent Order %;p constitute full settlement of all violations of <br />Chapter 6.95 of the California Health and Safety Code pertaining to the Site <br />and arising before the Effective Date of this Consent Order. This Consent <br />Order does not limit the CUPA from taking appropriate enforcement action <br />concerning any other violations. <br />8. Respondents t the violations described above. <br />SCHEDULE FOR COMPLIANCE <br />9. Facility has submitted statements and documents demonstrating <br />complP <br />ance with the 2016 and 2018 violations described above. <br />PAYMENTS <br />10. Respondents shall pay the CUPA $9,000.00; of which $3,374.44 are CUPA <br />costs and the remainder are penalties, within 30 days after Respondent <br />signs this Consent Order. <br />11. Respondent shall additionally pay the CUPA a $5,000.00 penalty if <br />Respondent fails to meet the following conditions during the five (5) year <br />period following the Effective Date of the Consent Order. The CUPA will <br />vacate the $5,000 penalty if Respondent meets the conditions during the 5 - <br />year period: <br />11.1 Respondent allows COPA inspectors to conduct Annual Hazardous <br />Waste and Hazardous Materials Business Plan inspections of the <br />facility, instead of only the current triennial inspections. The <br />inspections will be to verify continued compliance. The regularly <br />scheduled inspection in year 2022 will be at no cost to the <br />Respondent, as that inspection is covered by the operating permit <br />-4- <br />CONSENT ORDER Associated Tractor Service Inc. <br />
