WASTE DISCHARGE REQUIREIPTS -3- <br /> PARADISE POINT MARINA <br /> SEVEN RESORTS,INC. <br /> SAN JOAQUIN COUNTY <br /> stream excursion above a water quality objective for BOD,total suspended matter, settleable <br /> matter,total dissolved solids, temperature, dissolved oxygen, chlorine residual,total coliform and <br /> oil and grease. Effluent limitationsfor these constituents are included in this Order. This Order <br /> contains provisions that: <br /> a. require the Discharger to provide information as to whether the discharge may contain EPA <br /> priority pollutants and/or National Toxic Rule constituents that have a reasonable potential to <br /> cause or contribute to an in-stream excursion above a water quality objective; <br /> b. if the discharge causes or contributes to an in-stream excursion above a water quality <br /> objective, requires the Discharger to submit information to calculate effluent limitations for <br /> those constituents; and <br /> C. allows the Board to reopen this Order and include effluent limitations for those constituents. <br /> 12. The beneficial uses of Bishop Cut downstream of the discharge are municipal and domestic, <br /> industrial, and agricultural supply; water contact and noncontact recreation; esthetic enjoyment; <br /> navigation; groundwater recharge, fresh water replenishment; and preservation and enhancement of <br /> fish, wildlife and other aquatic resources. <br /> 13. The beneficial uses of the underlying groundwater are municipal and domestic,industrial, and <br /> agricultural supply. <br /> 14. The State Water Resources Control Board(SWRCB) adopted the Water Quality Control Plan for <br /> Control of Temperatures in Coastal and Interstate Waters and Enclosed Bay and Estuaries of <br /> California(the Thermal Plan) dated 18 September 1975. This discharge is subject to the <br /> requirements of the Thermal Plan and it is considered an existing discharge of elevated temperature <br /> waste. <br /> 15. The permitted discharge is consistent with the antidegradation provisions of 40 CFR 131.12 and <br /> State Water Resources Control Board Resolution 68-16. This Order provides for an increase in the <br /> volume and mass of pollutants discharged. The increase will not cause significant impacts on <br /> aquatic life,which is the beneficial use most likely affected by the pollutants discharged (BOD, <br /> suspended solids, total dissolved solids, chlorine residual,total Coliform,temperature, and metals). <br /> The increase will not cause a violation of water quality objectives. The increase in the discharge <br /> allows wastewater utility service necessary to accommodate housing and economic expansion in <br /> the area, and is considered to be a benefit to the people of the State. <br /> 16. The S WRCB, on 16 May 1974, adopted Resolution No. 74-43 titled"Water Quality Control <br /> Policy for Bays and Estuaries of California". This Policy is applicable to the discharge to Bishop <br /> Cut, an estuarine water of the state. <br />
