If noxious weeds are on the site, operations shall be in <br /> accordance with instructions from the Agricultural <br /> Commissioner of San Joaquin County. (Planning Title Section <br /> 9-2224{h}) <br /> j . Any night lighting established on the property shall be <br /> arranged and controlled so as not to illuminate public <br /> rights-of-way or adjacent properties. (Section 9-2244{e}) <br /> k. Excavations shall not cause health or sanitary hazards and <br /> shall not create conditions which will cause the breeding or <br /> increase of mosquitos, rodents, or other pests. (Section 9- <br /> 2244{i}) <br /> 1. A written notification of work schedules and an Improvement <br /> Plan shall be provided to the County by the applicant prior <br /> to any grading or excavation. The Improvement Plan shall <br /> reflect all of the adopted Conditions of Approval. One (1) <br /> copy of the Improvement Plan shall be submitted to the <br /> Development Services Division for distribution to the <br /> involved County departments. A plan check fee will be <br /> required. (Planning Title Section 9-2224{j }) <br /> M. At the completion of the grading, the applicant shall have a <br /> registered civil engineer or licensed land surveyor compare <br /> the excavation' s final elevations with the approved permit. <br /> The engineer or surveyor shall submit a certified, written <br /> finding to the Planning Division which states and documents <br /> the compliance or non-compliance of the excavation with all <br /> of the conditions of the approved permit, including <br /> documentation that fertilization has been completed per the <br /> laboratory recommendations submitted by applicant. (Section <br /> 9-2224{k}) <br /> n. To insure that the excavation is completed in conformance <br /> with the approved permit, the operator shall secure a <br /> performance bond or other financial security sufficient to <br /> cover the cost of rehabilitation of the site for agricultural <br /> use. The form of the bond or other financial security shall <br /> be found acceptable by County Counsel. (Section 9-2224{m}) <br /> o. The applicant shall not be required to replace the site's <br /> topsoil and excavated material may be removed from the site <br /> without stockpiling, following the County's acceptance of the <br /> performance guarantee. <br />
