(E) Advise the legislative body of the city or county <br /> of the terms, provisions, and conditions for project <br /> approval which have been agreed upon by the committee <br /> and the proponent, and of any additional information <br /> which the committee deems appropriate. The legislative <br /> body of the city or county may use this advice for its <br /> independent consideration of the project. <br /> Section 25199 .7 (d) ( 2) (A) of the Health & Safety Code <br /> requires the Committee to negotiate with the proponent concerning <br /> "detailed terms of. . .project approval. " Although mar;Y of the <br /> conditions proposed by the Committee are detailed, in that they <br /> specify specific amounts of oil to be input or output by the <br /> Project and specific requirements, many of the responses by the <br /> Product Sponsors are very general and refer only to meeting the <br /> mandates of state, local and federal regulations. We suggest <br /> that the Committee insist that the conditions be detailed and <br /> not-broad and general. Section (A) also provides that such <br /> conditions and provisions shall be for the benefit of "the <br /> environment of the city or county and would promote the fiscal <br /> welfare of the city or county through special benefits and <br /> compensation. " Subsection (A) appears to be specific <br /> authorization to negotiate specific sums of compensation as <br /> mitigation for impacts on the county. The Comm=ttee has proposed <br /> specific financial mitigation requirements. It seems to be <br /> impossible for the Committee to fulfill its obligation of <br /> specifying specific financial compensation when the Environmental <br /> Impact Report fails to identify specific sums required for <br /> mitigation. This would be dealt with in more detailed in the <br /> analysis of specific conditions which follows. <br /> Section 25199 .7 ( 2) (B) requires the Committee to negotiate <br /> with the Project proponents in the interests of residents of the <br /> city, county and adjacent communities. This subsection specifies <br /> that the Committee act as an advocate for the interests of the <br /> residents of the County of San Joaquin, not merely as a mediator. <br /> Finally, subsection (E) requires that you advise the <br /> Planning Commission and Board of Supervisors of the conditions <br /> upon which you have agreed. It also authorizes the Committee to <br /> provide as additional information any conditions which they feel <br /> would be appropriate, but to which the Project Sponsor has <br /> refused to agree. <br /> The Committee has requested to be provided with all comments <br /> to the Draft Environmental Impact Report. On behalf of the Farm <br /> Bureau, we submitted supplemental comments to the Draft <br /> Environmental Impact Report. These comments were dated June 2 , <br /> 1989 . Many of them specifically dealt with the inconsistencies <br /> between the Environmental Impact Report and the LAC Committee <br /> condition responses by the Project Sponsors and the consultant. <br /> The Department of Health Services has issued a Draft Series <br /> A Permit, and this Draft was supposed to be available for public <br /> 2 <br />
