Chapin and my brother Charles G. Chapin conducted <br /> business under a sub-lease from the Shell Oil Co. (address 1024 13 St. <br /> Sacramento, CA.) The property was known as L.P. 1666 and was located at 1766 <br /> Mt. Diablo Stockton, Ca. <br /> In the year of 1963, the daily accounting for reconciliation of storage tank versus <br /> pump and cash register sales indicated a significant shortage. This fuel loss was <br /> called to the attention of Shell Oil representatives which were the district <br /> manager and the dispatcher whom I believe to be a Mr. Volny Andrews. After <br /> explaining the disparity between my figures, Shell Oil's initial response was that I <br /> must have made a mistake in my calculations and they suggested that I re- <br /> calculate my figures. I re-calculated my figures and found that they were indeed <br /> correct. <br /> 1 continued to monitor the shortage over the next few weeks and again advised <br /> Shell Oil Co. that there was an apparent leak. After some discussion (days later) <br /> Shell Oil suggested that this loss could be an actual tank leak and they wanted the <br /> opportunity to monitor the shortage themselves. After several days of review <br /> they were unable to agree that the loss of product was occurring. (This <br /> inconsistency of leakage was revealed later to be attributed to the fact that the <br /> leak in the storage tank was in the upper portion, and once the product dropped <br /> below this level the leak stopped). <br /> Several days later after Shell Oil could not prove that there was indeed a leak, we <br /> received a delivery of fuel and the loss was again evident to us. We promptly <br /> telephoned Shell Oil and complained of the loss of fuel. They indicated that time <br /> would be necessary to re-evaluate the problem. in addition they advised us that <br /> this fuel loss could be caused by a shortage of tank delivery by their driver who <br /> may be selling their gas to another station in a covert manner. <br /> After several days Shell Oil arrived at the station and commenced thei ir own loss <br /> check. It was on this occasion that we expressed concern over the considerable <br /> delay in agreeing on the loss and the lack of action on their part. We further <br /> 1 <br />
