SUWAAJRY OF VIOLATIONS (CLASS I, CLASS II or MINOR -Notice to Comply) This is a report of the Routine hazardous waste inspection conducted at the referenced facility by San Joaquin County Environmental Health Department (EHD). The following are Class II (Repeat) violations: 108, 122,125, and the following are Minor -Notice to Comply: 301, 611 108. (Repeat) Generator was not able to provide return -to -compliance document on site, for the violation cited in Inspection Report dated December 8, 2009 requiring generator to make a hazardous waste determination of the 55 -gallon metal drum marked "Pesticide Residue Metal Phosphides", which is currently still on site but could not be open to verifiy if there's any content since there's lock on it. Generator shall make hazardous waste determination of the waste and manage the waste accordingly. Immediately make a hazardous waste determination of the above waste and manage accordingly, or dispose of the waste as hazardous waste in accordance to California Code of Regulations (CCR) Title 22. Submit to EHD a copy of the disposal record of the waste observed in 2009, and any waste still in the drum, by July 9, 2012. 122 & 125. (Repeat) Copies of hazardous waste disposal records for 2009 and 2010 were not found on site. Brett provided disposal records of 2011 and 2012 but stated there may be more at the head office in Pinole. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately locate a copy of all missing manifests and receipts for the last three years, maintain them on site, and submit copies to the EHD by July 9, 2012. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
