Oil stains and small amount of metal shavings around the vise at the work shop were observed. <br />Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of <br />hazardous waste to air, soil, or surface water which could threaten human health or the environment. <br />Please be aware that if metal waste is to be recycled, size of hazardous metal particles must be <br />determined before they can be recycled as scrap metal. Hazardous metal particles 100 microns or <br />smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. <br />Immediately clean up the above release, and manage according to Title 22 hazardous waste <br />regulations. Submit a statement and supporting documentation explaining how this waste was managed <br />by July 9, 2012. <br />611. Brett stated the drained oil filters observed in the 2009 inspection was not disposed until June 2012 <br />because he was waiting for the container to fill up. Facilities that generate up to one ton of used oil <br />filters per year may store the filters up to one year. Immediately begin recycle all used oil filters under a <br />bill of lading within one year of storage. <br />NOTES (The following are not violations) <br />The facility generated 1680 pounds of hazardous waste in 2011. This number may change after <br />generator provides all the missing disposal receipts. The facility generates hazardous waste from <br />maintenance of railway equipment on site, and occasionally used oil from maintenance work off site. <br />Verified all violations cited the December 8, 2009 hazardous waste inspection report have been <br />corrected except item #10 (see Item #108 above in this report), and that the drained oil filters cited in <br />item #33 were not disposed until June 2012. <br />Discussed with Brett Universal Waste management requirements including aerosol cans, lamps, alkaline <br />batteries, mercury containing switches, CRT, electronic devices, etc. in a closed container with a method <br />to identify the content and the start date of accumulation. Universal Wastes must be managed within 1 <br />year of accumulation, and the disposal records maintained on site for at least 3 years. A copy of CUPA <br />class schedule has been provided to generator during this inspection. <br />Submit the following to EHD by: July 9, 2012 <br />1) A completed copy of the (provided) Return to Compliance Certification (please keep original for <br />your records). <br />2) A written statement how each violation was corrected <br />3) Evidence (i.e. photos, disposal receipts, documents) in support of the corrections made. <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />Re ed By: <br />Title: <br />Jeffrey Wong (209) 468-0335 <br />EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
