The site is located in the rural center of Victor . <br /> For• rural centers, the site' s zoning, C-RC, is used as an <br /> implementation zone for the site ' s General Plan designation, <br /> Retail Commercial . <br /> Zoning:_ <br /> A Use Permit is required for this project because, under the <br /> provisions of the C-RC zone, the proposed residential use <br /> accessory to the permitted office use is listed as a con- <br /> ditional use type. <br /> The first project issue involves Planning Title Section <br /> 9-3233 (h) , which provides : <br /> "In all zones which require a front yard, no obstruction <br /> of view in excess of three (3) feet in height above the <br /> crown of the lower of the two intersecting streets shall <br /> be placed on any corner lot within a triangular area <br /> formed by the street property lines and a line connecting <br /> them at points thirty (30) feet from the intersection of <br /> the street lines, except a reasonable number of trees <br /> pruned to permit unobstructed vision to automobile drivers <br /> and pedestal-type identification signs and pumps at gaso- <br /> line service stations. " <br /> Although the proposed building location complies with the C-RC <br /> front yard regulations, it does not comply with Section <br /> 9-3233 (h) . The front yard setback would have to be increased, <br /> or the building size decreased, to place the building outside <br /> of the 30-foot snipe . This is true whether or not a five-foot <br /> dedication is required on Second Street . Switching the <br /> building location with the lawn area location would solve this <br /> problem without reducing the building size. <br /> The Second Street project issue involves the Department of <br /> Public Works ' requirement of a five-foot dedication along <br /> Second Street . The dedication is required to allow construc- <br /> tion, by the applicant , of frontage improvements in conformance <br /> with County standards for one-half of a 50-foot-wide right-of- <br /> way urban street .
