Immediately update the <br />contingency plan for this facility to include all of the necessary information and <br />submit a copy of the plan to the EHD by September 19, 2013. REPEAT <br />VIOLATION <br />Ryder Fuel Services has made the necessary changes to the contingency plan for <br />the facility. A copy of the plan has been uploaded to CERS and is included as <br />part of this response. <br />#2 Violation Text: #122, 123, 124 — Failed to keep signed copy of manifests from <br />the designated facilityfor 3 years. Failed to determine status of hazardous waste <br />when copy of manifest signed by designation facility not received within 35 <br />days. Failed to file an exception report when copy of manifest signed by <br />destination facility not received within 45 days. The following manifest <br />numbers were not found on site: <br />- 002570518SKS (8/30/11) <br />- 002663763SKS (11/23/11) <br />- 002952770SKS (1/10/12) <br />Copies of three of the manifests were located on the transporter's website, but <br />TSDF signed copies could not be found. Hazardous waste generators shall <br />retain copies of all manifests for three years or until a copy signed off by the <br />destination facility is received. The signed off copy shall be retained and made <br />readily available for review for three years. If the generator did not receive a <br />copy of the manifest with the handwritten signature of the owner or operator of <br />the facility to which the generator's waste was submitted within 35 days of the <br />date the waste was accepted by the initial transporter, the generator shall <br />contact the transporter and/or the owner or operator of the designated facility to <br />determine the status of the waste. If the generator did not receive a copy of the <br />signed off copy of the manifest within 45 days of the date that the waste was <br />accepted by the initial transporter, the generator shall submit an Exception <br />Report that includes a legible copy of the missing manifest, and a cover letter <br />signed by the generator explaining the efforts to locate the hazardous waste and <br />the results of those efforts.
