HAZELTON AVE., STOCKTON, CA 95205 CHET DAVISSON <br /> PLANNING PHONE: 209/944-3722 Director <br /> BUILDING PHONE: 209/944-3701 JERRY HERZICK <br /> Deputy Director <br /> November 10 , 19$7 TOM WALKER <br /> Deputy Director <br /> MEMORANDUM <br /> TO: Development Committee <br /> FROM: Bill Factor, Associate Planner <br /> SUBJECT: Pre-Application Conference for General Plan Amendment <br /> No. GP-88-15 , Zone Reclassification No. ZR-88-12 , & <br /> Williamson Act Cancellation No. WC-88-3 <br /> --------------------------------------------------------------- <br /> The pre-application conference concerns a proposed General Plan <br /> Map Amendment from Agriculture and Low Density Residential to <br /> Low, Medium, and High Density Residential; and accompanying re- <br /> classification request from GA-40 to R1-4 , R-2 , & R-4 ; and a <br /> Williamson Act cancellation request for the 62 acres under consideration. <br /> The Planning Division has reviewed the above projects and offers <br /> the following comments : <br /> Williamson Act Cancellation - Williamson Act property may be can- <br /> celled either under one of two sets of findings . Under the first <br /> set of findings, the Board of Supervisors must find that the pro- <br /> posed alternative use of the property is consistent with the General <br /> Plan. Under the second set of findings, there is no General Plan <br /> consistency requirement. Instead, the Board must find that the <br /> cancellation is in the public interest and that there is no proxi- <br /> mate noncontracted land, both available and suitable, that could <br /> accommodate the proposed use. Because the proposed General Plan <br /> Amendment under the first set of findings would have to be in <br /> place before the cancellation request is acted on by the Board, <br /> and because the applicant wishes to obtain tentative Williamson <br /> Act cancellation prior to the end of the year, staff recommends <br /> that the applicant do the following: <br /> 1 . Request that the Board take action on the cancellation request <br /> on the basis of the second set of findings. <br /> 2 . Provide documentation or evidence to the Board in support <br /> of the finding that there is no proximate noncontracted land, <br /> both available and suitable, that could accommodate the pro- <br /> posed use. <br />
