Mr. Factor <br /> Page Three <br /> for the use to which it is proposed the contracted land be put, <br /> or, that development of the contracted land would provide more <br /> contiguous patterns of urban development than development of <br /> proximate non-contracted land. <br /> The EIR should assess the impacts of any required cancellations <br /> of Williamson Act contract(s), as well as any of the following <br /> data: <br /> The location of Williamson Act contracts on lands <br /> within and adjacent to the planning area. <br /> A discussion of the effects that cancellation of <br /> Williamson Act contracts would have on nearby <br /> properties also under contract. <br /> Recently, there have been a number of requests for cancellation <br /> of Williamson Act contracts. We recommend that these proposed <br /> cancellations and the ensuing development be analyzed to <br /> determine the cumulative and growth inducing impacts on other <br /> farmland in and around the Tracy area. Also, analyze the type and <br /> amount of farmland conversion that would result from <br /> implementation of this project. <br /> We also note that the City of Tracy anticipates that the property <br /> will be annexed to the City. Therefore, the EIR should address <br /> the provisions of Government Code Section 51243 which state, "On <br /> the annexation by a city of any land under contract with a <br /> county, the city shall succeed to all rights, duties and powers <br /> of the county under such contract unless the land being annexed <br /> was within one mile of such city at the time that the contract <br /> was initially executed, the city has filed and the local agency <br /> formation commission has approved a protest to the contract <br /> pursuant to Section 51243 . 5, and the city states its intent not <br /> to succeed in its resolution of intention to annex. If the city <br /> does not exercise its option to succeed, the contract becomes <br /> null and void as to the land actually being annexed on the date <br /> of annexation. In the event that only part of the land under <br /> contract was within one mile of the city, the option of the city <br /> shall extend only to such part. " <br /> o Mitigation measures and alternatives that would lessen the <br /> farmland conversion. Some of the possibilities are: <br /> Direct growth to lower quality soils in order to <br /> protect prime agricultural land. <br /> Protect other, existing farmland through the use of <br /> Williamson Act contracts. <br /> Establish greenbelt and open space areas. <br />
