27 March 2009 <br /> i AGE-NC Project No. 08- 1607 <br /> Page 2 of 2 <br /> i <br /> Board requesting their determination of the F&B evaluation and conclusion of the second <br /> Ilf release. <br /> 1 According to the Regional Board (Mr. Barton), via telephone conversation with AGE (Mr. <br /> I Arthur Deicke), the Regional Board completed their analysis of the F&B evaluation and <br /> forwarded their analysis to SJCEHD for their final determination on 19 February 2009. <br /> • According to SJCEHD (Mr. Nuel Henderson), the Regional Board analysis of the F&B <br /> I <br /> evaluation and data had been received, but SJCEHD had not sufficient time to respond. <br /> On 11 March 2009, SJCEHD issued a letter further directing the submission of a feasibility <br /> study for additional remediation and a work plan for additional assessment and required these <br /> j documents 10 April 2009. <br /> i <br /> I As of this date, SJCEHD has not responded to the data and analysis performed by F&B and the <br /> Regional Board. Until the SJCEHD determination of a second release is made, no further <br /> environmental work is scheduled during the second quarter of 2009. <br /> i <br /> i Canepa' s will require SJCEHD to make an immediate determination of the data and analysis <br /> performed by both F&B and the Regional Board prior to proceeding with additional work. This <br /> pending decision is imperative for Canepa ' s to evaluate the allocation of limited resources to the site <br /> investigation and clean-up given the financial cap of the Underground Storage Tank Cleanup Fund. <br /> The evaluation of the F&B determination is also critical to the continued assessment and/or <br /> remediation of the site.
