The
letter informed you that your claim is not eligible for placement on the Fund 's Priority List
because you did not submit the required documentation necessary to make an eligibility
determination .
In response, you provided the requested documentation . However, your claim is not
eligible for participation in the Fund for the following reason :
• The release from the three 12 , 000-galllon Underground Storage Tanks (USTs) that
are the subject of this claim does not qualify as a separate "occurrence" from the
release funded under Claim No, 8449 ,
Background
UST System #1
Remo and Marion Canepa acquired the site in 1966 and installed three USTs (two
10 , 000-gallons , one 5 , 000-gallon .) For ease of reference, I will refer to these as UST
System #1 . The Canepas owned and operated the tanks until 1972 . In 1972 Canepa's Car
Wash operated the tanks until they were removed in February 1993 , when a release was
discovered . On March 11 , 1994 , Canepa's Car Wash applied to the Fund and was
accepted. On November 10, 1994, the Fund issued a Letter of Commitment and Canepa's
Car Wash was reimbursed 1 . 5 million dollars (less deductible) under Claim No . 8449 .
Although the release for Claim No. 8449 was not fully investigated and San Joaquin County
Environmental Health Department (San Joaquin County) had not granted site closure, the
FELICIA MARCUS, CHAIR I THOMAS HOwARD, EXECUTIVE OFFICER
1 DOI I Street 51IMMONo, CA 95814 1 N131in
g Aptlle. .
