I <br /> Canepa's Car Wash 2 <br /> Claim No, 019982 <br /> Fund closed Claim No . 8449 on December 19, 2011 , because Canepa's Car Wash <br /> received the maximum reimbursement per occurrence for the claim . <br /> UST System #2 <br /> In April 1993 Canepa's Car Wash installed a new UST system (three 12 , 000-gallons), <br /> which I will refer to as UST System #2. On March 6, 2012 , San Joaquin County concluded <br /> a probable second release occurred between 1998 and 2002 from UST System #2. On <br /> October 17, 2012 , the Fund received a claim application . Our investigation confirmed a <br /> subsequent release occurred from UST System #2; however, the second release for Claim <br /> No . 19982 was not a separate occurrence from the first release funded under <br /> Claim No. 8449, <br /> Discussion <br /> Occurrence <br /> Section 25299. 19 of Chapter 6.75, Division 20 of the California Health and Safety <br /> Code defines "occurrence" as follows: "An accident, .including continuous or <br /> repeated exposure to conditions, which results in an unauthorized release of <br /> petroleum from a UST. Unauthorized releases at the same site which require only a <br /> single site investigation shall be considered as one occurrence. An unauthorized <br /> release subsequent to a previous unauthorized release at the same site shall only _ <br /> be considered a separate occurrence if an initial site investigation has been <br /> completed for the prior unauthorized release. <br /> Initial Site Investigation <br /> Section 2804 of Chapter 18, Division 3, and Title 23 of the Petroleum UST Fund <br /> Regulations defines "initial site investigation" as follows: "A soil and groundwater <br /> investigation sufficient to identify where contamination resulting from an <br /> unauthorized release is most likely to be present." <br /> Based on the Fund's review of the application and supporting documentation submitted, the <br /> initial site investigation for UST System #1 had not been completed in 2002 . This is evident <br /> based on the following correspondences from San Joaquin County relating to UST <br /> System #1 : <br /> • On October 28, 2004, the County approved the remedial action plan for soil and <br /> groundwater. <br /> • By letters dated December 1 , 2008, and May 18, 2011 , respectively, the County <br /> directed Canepa's Car Wash to submit a work plan to complete the lateral <br /> delineation of impacted groundwater. <br />
