The tank <br /> owner or operator must notify the Fund Manager should they choose not to have their case <br /> reviewed within 30 days of notification. Based on this review, the Fund Manager, with approval <br /> of the tank owner or operator, may make a recommendation to the State Board for closure. The <br /> State Board may require the closure of a tank case which is under the jurisdiction of a Regional <br /> Board or local agency participating in the State Board's local oversight program. <br /> Your Fund claim has a LOC, which during the 1998-99 Fiscal Year will have been active for five <br /> (5) years or more. By notice of this letter, I am informing you of my intent to review your tank <br /> ca§e for possible closure. Should you choose not to have your tank case reviewed, you must <br /> notify this office in writing, no later than thirty (30) days from the receipt of this letter. <br /> Following our review of your case, you will be notified should it be determined that your case is <br /> a candidate for closure. <br /> Please be aware that: <br /> 1 . The 5-year review is only a review of your existing Fund claim file to identify if your tank <br /> case may be a candidate for closure. <br /> 2. Should Fund staff determine that your case is a candidate for closure, and you choose to have <br /> Fund staff continue efforts to pursue closure, Fund staff will contact the responsible oversight <br /> agency to obtain any additional information and data pertaining to your case. <br /> 3 .
