Attached to the Petition for Review and for Stay, <br /> 3 as Exhibit 6, is a true and correct copy of the letter that I received from Ms. Lagorio on or about <br /> 4 July 3, 1997. <br /> 5 6. I am informed and believe and based upon such information and belief <br /> 6 state that in or about July 1997, PHS/EHD referred this site to the San Joaquin Countv District <br /> 7 Attorney's Office (the"District Attorney")for enforcement action with full knowledge that Unocal <br /> 8 had petitinnerl the fitate Rnard for cloture of the Sit&. Prior to reeeivinL! Ms. Laaenrin's hely 3, <br /> 9 1997 letter, PHS/EHD had given me no indication that there were compliance issues associated <br /> 10 with the Site or that it intended to refer it to the District Attorney for enforcement action, nor, to <br /> 11 my information and belieā¬,had PHSM DJ so informed anyone else at Unocal. <br /> 12 7. Although Unocal was unaware of any PIIS/DIID diroctivc that it had <br /> 13 failed to comply with, and believed that it had submitted a valid petition fur LluNurc of the Sits to <br /> 14 dic Stxstc Butird, 1, along with outer Unocal representatives, mct with Donna Herm, Director of <br /> 15 PHS/EHD, on April 28, 1998, in an cf'#'ort to determine what could be done to address PHS/EHD's <br /> 16 concerns about the Site. As a result of the meeting, Unocal agreed to submit a workplan for <br /> 17 additional characterization of the Site. The workplan was approved by PHS/EHD in August 1998, <br /> is the work completed during January and February 1999, and the report of the supplemental work <br /> 19 submitted.to PHS/EHD, all at a cost of approximately $61,700. <br /> 20 8. On or about February 11, 1999, 1 received from Dennis Parfitt of the <br /> 21 Division of Clean Water Programs, a copy of the Division of Clean Water Programs' January 25, <br /> 22 1999 memorandum to the Central Valley Regional Water Quality Control Board ("the Regional <br /> 23 Board") informing the Regional Board of its intention to recommend closure of the Site to the <br /> 24 State Board at its March 13, 1999 workshop. Attached to the Petition for Review and for Stay, as <br /> 25 Exhibit 7, is a free and correct copy of the January 25, 1999 memorandum that I received from <br /> 26 Mr. Parfitt. On or about March 2, 1999, Mr. Parfitt faxed to me a copy of a February 16, 1999 <br /> 27 memorandum from the Regional Board to the Division of Clean Water Programs objecting to its <br /> 28 recommendation that the Site be closed. A true and correct copy of the February 16, 1999 <br /> -3- <br />
