� r- <br /> 9 <br /> R <br /> Dave Deaner <br /> Page 2 <br /> As stated in a letter dated January 16, 1998, to your agency, PHS/EHD is concerned <br /> with UNOCAL's failure to determine the lateral and vertical extent of contamination at <br /> IF the site as well as statements made in their closure request. A copy of that letter is part <br /> of our records being submitted to you with this letter. <br /> This site has been referred to the San Joaquin County District Attomey, Environmental <br /> Prosecutions Unit (SJCDA/EPU) for legal action because it is out of compliance with <br /> PHS/EHD directives which are based on California laws, regulations and adopted <br /> policies. It should be noted by the State Water Resources Control Board that <br /> numerous other UNOCAL sites also have.been referred to the SJCDA/EPU for <br /> enforcement action. It is our understanding that the SJCDA/EPU and UNOCAL's <br /> counsel are working toward a satisfactory resolution of all referred issues. <br /> PHS/EHD met with UNOCAL representatives on April 28, 1998 to discuss the prior site <br /> assessment and remediation activities and future assessment and corrective action plan <br /> requirements. A work plan was submitted in May 1998 and PHS/EHD commented on <br /> the work plan in a letter dated June 26, 1998. A copy of that letter was sent by facsimile <br /> to your office on July 21, 1998, and there is a copy of the letter in the records being <br /> submitted to you with this letter. <br /> The PHS/EHD letters dated January 16, 1998 and June 26, 1998 provide our agency's <br /> position on this site. UNOCAL has replied to PHS/EHD comments on the work plan that <br /> was submitted in May 1998.
