{' KLEINFELDER <br /> is prepared to assist the client and to remediate or dispose of stockpiled soil and water, if <br /> requested, at an additional cost. <br /> • This proposal is based on the presumption that the client will clearly mark utilities and <br /> will provide any and all available survey maps or other data to determine the location of <br /> tanks, existing structures, underground utilities and services. The client should be aware <br /> that penetrating the site's surface is inherently risky. It is impossible to determine with <br /> certainty the precise location of all structures (such as septic system tanks, leach fields or <br /> irrigation lines) which may be buried in the ground. Kleinfelder's fee is not adequate to <br /> compensate for both the performance of the services and the assumption of risk of <br /> damage to such structures. Disruption of utilities or damage to underground structures <br /> will not be the responsibility of Kleinfelder. Costs incurred by Kleinfelder for repair to <br /> underground structures will be billed to the client at cost. <br /> • Underground Services Alert (USA) at 1-800-642-2444 provides a partial location service <br /> free of charge for major utility lines. It is important that Mark Thomas & Company <br /> understands that subsurface structures buried under private property will not be marked <br /> by the public utility companies contacted by USA. Kleinfelder will contact USA prior to <br /> beginning field activities. <br /> AUTHORIZATION <br /> Our services will be performed in accordance with the terms and conditions of our existing <br /> agreement with Mark Thomas & Company. Please indicate your acceptance of this proposal by <br /> signing and returning the attached Work Requisition. A fully executed copy will be returned for <br /> your files. <br /> If there is a need for any change in the scope of services or schedule described in the proposal or <br /> in our contract, please call us immediately. Changes may require revision of the proposed fees. <br /> All terms and conditions indicated in this proposal will be considered by both parties to be in <br /> effect from the date of Mark Thomas & Company's signed authorization. The proposal will <br /> remain in effect for 90 days from the date shown on the proposal and thereafter shall be null and <br /> void unless our Work Requisition has been signed for the work performed. If Mark Thomas & <br /> Company's requests a delay in the work after authorization to proceed has been given, there may <br /> be a need to re-evaluate the estimated fees. <br /> All information gathered during the study by Kleinfelder will be considered confidential and will <br /> be released only upon written authorization from the Client, or as required by law. California <br /> law requires a person to inform the State if a situation is encountered that can be considered an <br /> immediate endangerment to the public's health or welfare and/or to the environment.
