ATTACHMENT A QX-90-1 CONDITIONS OF APPROVAL Unless otherwise specified, all Conditions of Approval shall be complied with prior to the initiation of use. 1. PLANNING DIVISION: Conditions of Approval : a. The extraction pits shall be aligned perpendicularly to the stream flow of the Mokelumne River, and extraction shall commence on the west end of the project area, continuing in an easterly direction. Stockpiled top soil and subsoil shall be replaced in the extraction pits following the completion of excavation. Details shall be shown in the Excavation Plan. b. This approval shall not permit extraction below the level of the water table. C. Truck loads crossing the project bridge must be fully contained to prevent accidental spill or release of materials into the Mokelumne River. An emergency spill containment and contingency plan shall be submitted to and approved by the Planning Division prior to project construction. d. Excavation shall be limited along the bluff to the south and east of the project area to avoid removal of native trees in these areas. If certain trees cannot be feasibly avoided, mitigation shall be as follows: (1) Replacement of trees shall be at a ratio of five to one for Valley Oaks and three to one for other native trees six inches or greater in diameter, measured at 4 . 5 feet above ground level. Replacement trees shall be five-gallon trees with drip irrigation provided for a period of at least three years. It shall be the responsibility of the applicant to maintain replacement trees. (2) The Excavation Plan shall identify all trees that would be lost or whose drip line would be impacted by excavation. The applicant shall have a qualified biologist or a certified arborist conduct an inventory of the trees that would be impacted by the excavation. The tree inventory will be submitted as an appendix of the Excavation Plan. -1-
