e. No excavation or other activity shall occur within five feet of the dripline of the trees that will not be removed. The applicant shall install and maintain protective fencing to protect those areas within five feet of the drip line of these trees. Fence details shall be shown on the Excavation Plan. f. Prior to construction of the access road and bridge, a survey shall be conducted by a qualified wildlife biologist to identify any raptor nests in the riparian corridor within 100 feet of the area to be disturbed. If raptor nests are identified in this area, no construction shall be conducted during the nesting season for these birds. Any such raptor nest shall be shown on the Excavation Plan. g. To mitigate for the impact to riparian habitat along the route of the proposed access road and bridge, disturbed scrub, freshwater marsh north of the Mokelumne River, and grassland with scattered trees in the borrow area, the following mitigation shall be provided: On the north side of the Mokelumne River, a 100-foot buffer from the northern edge of the riparian corridor (as defined by the outer canopy edge of the Riparian Overstory) shall be developed to provide additional habitat and screen the riparian corridor from operations at the processing facility and future agricultural activity. This buffer shall extend the length of the area proposed for reclamation north of the river. This buffer shall include preservation of the freshwater marsh area. A Revegetation Plan utilizing native trees and shrubs shall be developed to provide effective screening from mining and agricultural activities and enhance wildlife habitat within the buffer zone. This plan should be prepared by a qualified biologist and submitted to the County for approval prior to initiation of excavation, and it shall be included in the Excavation Plan. The plan shall also include a schedule for installation and maintenance procedures. It shall be the responsibility of the applicant to maintain and protect such habitat and plants. At a minimum, the revegetation plan should replace lost trees within the riparian corridor by planting trees within the buffer as follows: Replacement of trees shall be at a ratio of five to one for Valley Oaks and three to one for other native trees six inches or greater in diameter, measured at 4 . 5 feet above ground level. Replacement trees shall be five- gallon trees with drip irrigation provided for a period of at least three years. It shall be the responsibility of the applicant to maintain replacement trees. The -2-
