e. No excavation or other activity shall occur within five <br /> feet of the dripline of the trees that will not be <br /> removed. The applicant shall install and maintain <br /> protective fencing to protect those areas within five <br /> feet of the drip line of these trees. Fence details <br /> shall be shown on the Excavation Plan. <br /> f. Prior to construction of the access road and bridge, a <br /> survey shall be conducted by a qualified wildlife <br /> biologist to identify any raptor nests in the riparian <br /> corridor within 100 feet of the area to be disturbed. If <br /> raptor nests are identified in this area, no construction <br /> shall be conducted during the nesting season for these <br /> birds. Any such raptor nest shall be shown on the <br /> Excavation Plan. <br /> g. To mitigate for the impact to riparian habitat along the <br /> route of the proposed access road and bridge, disturbed <br /> scrub, freshwater marsh north of the Mokelumne River, and <br /> grassland with scattered trees in the borrow area, the <br /> following mitigation shall be provided: <br /> On the north side of the Mokelumne River, a 100-foot <br /> buffer from the northern edge of the riparian corridor <br /> (as defined by the outer canopy edge of the Riparian <br /> Overstory) shall be developed to provide additional <br /> habitat and screen the riparian corridor from operations <br /> at the processing facility and future agricultural <br /> activity. This buffer shall extend the length of the <br /> area proposed for reclamation north of the river. This <br /> buffer shall include preservation of the freshwater marsh <br /> area. A Revegetation Plan utilizing native trees and <br /> shrubs shall be developed to provide effective screening <br /> from mining and agricultural activities and enhance <br /> wildlife habitat within the buffer zone. This plan <br /> should be prepared by a qualified biologist and submitted <br /> to the County for approval prior to initiation of <br /> excavation, and it shall be included in the Excavation <br /> Plan. The plan shall also include a schedule for <br /> installation and maintenance procedures. It shall be the <br /> responsibility of the applicant to maintain and protect <br /> such habitat and plants. At a minimum, the revegetation <br /> plan should replace lost trees within the riparian <br /> corridor by planting trees within the buffer as follows: <br /> Replacement of trees shall be at a ratio of five to one <br /> for Valley Oaks and three to one for other native trees <br /> six inches or greater in diameter, measured at 4 . 5 feet <br /> above ground level. Replacement trees shall be five- <br /> gallon trees with drip irrigation provided for a period <br /> of at least three years. It shall be the responsibility <br /> of the applicant to maintain replacement trees. The <br /> -2- <br />
