construction. This mitigation shall involve expansion of <br /> the existing freshwater marsh at a rate of five to one, <br /> reflecting staff 's recommendation on the San Joaquin <br /> County General Plan 2010. The Plan shall be prepared by <br /> a qualified biologist, and it shall include a scheduled <br /> for installation and maintenance procedures. It shall be <br /> the responsibility of the applicant to maintain, <br /> irrigate, and protect such habitat for a period of at <br /> least three years. Evidence of Fish and Game ' s approval <br /> of the Habitat Mitigation Plan and a copy of the approved <br /> Section 404 Permit shall be submitted to the Planning <br /> Division. <br /> Y- To reduce the potential for impact to water quality and <br /> to protect fisheries from bank erosion, bridge <br /> construction shall be conducted to minimize constriction <br /> of the channel and prevent a decrease in flood carrying <br /> capacity of the Mokelumne River. <br /> Z. Processing plant operations shall be from 5 : 00 a.m. to <br /> 9 : 00 p.m. , Monday through Saturday, except during periods <br /> of declared national, state, or county emergency. <br /> aa. Extraction operations shall be from 6: 00 a.m. to 6: 00 <br /> P.m. , Monday through Friday, except during periods of <br /> declared national, state, or county emergency. <br /> bb. The applicant shall retain the services of a qualified <br /> archaeologist to evaluate all archaeological finds during <br /> excavation and propose mitigations as appropriate. If <br /> human remains are encountered during excavation, the <br /> applicant shall contact a qualified archaeologist <br /> immediately to assess the find. CEQA Guidelines, <br /> Appendix K, shall also be reviewed for proper legal <br /> procedure in case of accidental discovery of human <br /> remains. Immediate notification shall be given to the <br /> Planning Division in the event of such a find. <br /> CC. No stockpiled soil or material shall be placed closer <br /> than 25 feet to a property boundary except as provided <br /> for in Section 9-2244 (o) of the Planning Title. <br /> dd. Final elevations within 25 feet of any property boundary <br /> shall be equal to or greater than the abutting property <br /> unless the elevation prior to excavation is less than <br /> that of the abutting property, in which case the <br /> differential shall not be increased. <br /> ee. The reclamation of each phase shall be completed, in <br /> conformance with the Reclamation Plan, within two years <br /> Of completion of the extraction portion of that phase. <br /> -6- <br />
