RESPONSE TO COMMENTS FROM: California Department of Conservation <br /> 1. The discussion of the SMARA under Section 1.5 of the EIR has been expanded <br /> to reflect responsibilities of the State, the lead agency, and the applicant. <br /> 2. Vegetation and wildlife surveys were conducted at the site during April 1990. <br /> Because the exact relocation area for the bridge and access road had not been <br /> established, mitigation measures rely on final evaluation of the riparian corridor <br /> and marsh areas once the exact route has been identified. Although these areas <br /> require additional surveying, sensitive species that may be present are identified <br /> and specific mitigations are provided in the event that these species are found in <br /> the area to be affected. The mitigation measures that require additional <br /> investigations have been modified in the EIR to require that the firm or <br /> individuals conducting the surveys be approved by the County. <br /> 3. Surface soil thickness and characteristics vary widely across the site and for this <br /> reason, it is not practical to establish a uniform depth of excavation for surface <br /> horizons. Mitigation 4, Section 3.1.3 has been changed to require that a plan for <br /> soil segregation and resoiling be submitted to and reviewed by the County, the <br /> Soil Conservation Service, and the Division of Mines and Geology. <br /> 4. Mitigation 9, Section 3.2.3 of the EIR has been revised, requiring that a <br /> Reclamation Plan (including revegetation) for the project be submitted to and <br /> approved by the County and the Division of Mines and Geology prior to <br /> commencement of project operations. <br /> 5. This mitigation measure (Section 3.3.3) has been changed to require that any <br /> Valley Oak removed shall be replaced at a rate of five to one with one to five <br /> gallon trees. Other native trees removed, larger than six inches in diameter <br /> measured at 4.5 feet above ground level, shall be replaced at a rate of three to <br /> one with one to five gallon trees. Replacement trees shall be provided with drip <br /> irrigation for a period of three years. <br /> 6. Mitigation 5, Section 3.3. of the EIR has been changed to require protective <br /> fencing for elderberries on site. <br /> 7. The Mitigation Monitoring Plan, Section 8.0 of the EIR has been revised to <br /> require that the resoiling plan and the reclamation plan (including revegetation) <br /> also be reviewed by the Division of Mines and Geology. <br /> 8. Section 1.5 of the EIR has been changed to reflect permit requirements under <br /> SMARA. Mitigation 9, Section 3.2.3 has been revised, requiring the applicant to <br /> submit a reclamation plan and necessary permit application under SMARA for <br /> approval by the County and the Division of Mines and Geology. <br />
