RESPONSE TO COMMENTS FROM: California Department of Fish and Game <br /> 1. The potential for impacts from the project as a result of high stream flows <br /> (including levee failure) is small and mitigations provided in Section 3.2.3 of the <br /> EIR reduce these potential impacts to less than significant levels. <br /> Mitigation 12 has been added to Section 3.2.3 of the EIR requiring that loads <br /> crossing the bridge be fully contained and that an emergency spill containment <br /> and contingency plan be submitted to and approved by the County prior to <br /> project operation. <br /> Accumulated water in the excavation site would not be discharge to surface <br /> waters, but would be diverted to the proposed impoundment. If groundwater <br /> were encountered necessitating excavation pit dewatering, discharge of pumped <br /> water to surface waters would be necessary. Mitigation 6 has been added to <br /> Section 3.2.3 of the EIR requiring the applicant to contact the Regional Water <br /> Quality Control Board, Central Valley Region in the event groundwater is <br /> encountered, and obtain a Waste Discharge Permit and/or a National Pollution <br /> Discharge Elimination System (NPDES) permit as necessary. <br /> 2. It is not the intent of this EIR to recommend that a specific project alternative <br /> be selected. Mitigation measures have been provided to reduce the proposed <br /> project impacts to less than significant levels where possible. The lead agency <br /> may require the applicant to further investigate one or more of the project <br /> alternatives if deemed appropriate. <br /> 3. Mitigation 13 has been added to Section 3.2.3 of the EIR to reflect these <br /> requirements. <br />
