PC: 9-6-90 <br /> QX-90-1 <br /> Replacement of trees shall be at a ratio of five to one <br /> for Valley Oaks and three to one for other native trees <br /> six inches or greater in diameter, measured at 4 . 5 feet <br /> above ground level. Replacement trees shall be five- <br /> gallon trees with drip irrigation provided for a period <br /> of at least three years. It shall be the responsibility <br /> of the applicant to maintain replacement trees. The <br /> location of replacement trees shall be shown on the <br /> Excavation Plan. <br /> An Irrevocable Offer of Dedication shall be made on all <br /> the site ' s riparian habitat (as defined by the outer <br /> canopy edge of the Riparian Overstory) in favor of the <br /> San Joaquin Open Space and Farmland Trust in order to <br /> transfer development rights. The applicant shall enter <br /> into an agreement with the Trust to provide funds for the <br /> administration and maintenance of this habitat. A copy <br /> of the agreement shall be submitted to the Planning <br /> Division. <br /> h. An acoustical study, prepared by a qualified acoustical <br /> engineer, shall be prepared prior to the initiation of <br /> excavation. The study shall identify the location of the <br /> project' s 65 db Ldn noise contour and development <br /> mitigations for compliance with Section 9-3800 (b) of the <br /> Planning Title. The applicant shall implement noise <br /> attenuation measures, as necessary, to comply with the <br /> provisions of Section 9-3800 (b) . <br /> i. The haul route from the excavation site to the Mokelumne <br /> River shall be screened with trees and other vegetation <br /> that shall be installed prior to the initiation of the <br /> use. Details of the vegetative screen, including <br /> maintenance and irrigation specifications, shall be <br /> included in the Excavation Plan. <br /> j . Excavation equipment shall be removed from the excavation <br /> area to locations which are visually screened from the <br /> town of Clements during weekends, holidays, and other <br /> periods of extended nonoperation (greater than one day) . <br /> The equipment storage area shall be shown on the <br /> Excavation Plan. <br /> k. The applicant shall retain the services of a qualified <br /> Civil Engineer to conduct an annual inspection of the <br /> site and to report to the Planning Division on the status <br /> of permit compliance. The report shall be submitted to <br /> -38- <br />
