PC: 9-6-90 <br /> QX-90-1 <br /> disturbance of Valley oak trees and Elderberry plants . <br /> If these species cannot be avoided, a survey shall be <br /> conducted by a qualified arborist or biologist once the <br /> final alignment of the bridge and access road has been <br /> staked. Each Valley oak that will be removed shall be <br /> replaced at a rate of f ive to one . These replacement <br /> trees shall be five-gallon trees planted along the <br /> Mokelumne River, in the area where the existing bridge <br /> will be removed, to enhance the riparian vegetation in <br /> that area . Drip irrigation shall be provided for the <br /> replacement trees for a period of at least three years . <br /> Any Elderberry that would be impacted by the bridge and <br /> access road shall be relocated within an unimpacted area <br /> of the riparian corridor according to USFWS <br /> specification . Protective fencing shall be installed <br /> around any Elderberry in the vicinity of the access road <br /> and bridge. All details shall be shown in the Excavation <br /> Plan. It shall be the applicant ' s responsibility to <br /> install all trees and plants prior to the initiation of <br /> the use and to maintain replacement trees and plants . <br /> W. Prior to construction of the access road, a survey shall <br /> be conducted for the presence of Delta button celery <br /> plants in that portion of the freshwater marsh that would <br /> be affected by the access road. If Delta button celery <br /> is identified in this area, mitigation shall be provided <br /> as designated by the USFWS. The survey shall be <br /> conducted by a qualified biologist. The location of all <br /> identified plants and the USFWS-approved mitigation <br /> measures shall be included in the Excavation Plan. <br /> X. Prior to excavation, a Habitat Mitigation Plan shall be <br /> developed and submitted to the Planning Division and the <br /> California Department of Fish and Game for approval. The <br /> applicant shall also secure a Section 404 permit from the <br /> U. S. Army Corps of Engineers, as required by the Clean <br /> Water Act. The Plan shall provide for the development <br /> of wetland habitat to compensate for any of the <br /> freshwater marsh that would be affected by the access <br /> road construction. This mitigation shall involve <br /> expansion of the existing freshwater marsh at a rate of <br /> five to one, reflecting staff ' s recommendation on the San <br /> Joaquin County General Plan 2010 . The Plan shall be <br /> prepared by a qualified biologist, and it shall include <br /> a scheduled for installation and maintenance procedures. <br /> It shall be the responsibility of the applicant to <br /> maintain, irrigate, and protect such habitat for a period <br /> -41- <br />
