Final elevations within 25 feet of any property boundary shall be equal to or greater than the abutting property unless the elevation prior to excavation is less than that of the abutting property, in which case the differential shall not be increased. hh. Operations shall be in accordance with instructions from the Agricultural Commissioner to control the spread of noxious weeds . Evidence of the Agricultural Commissioner ' s approval of the Weed Control Plan shall be submitted to the Planning Division. ii . The excavation shall not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitoes , rodents , or other pests . jj . A performance guarantee is required to ensure site rehabilitation and compliance with Conditions of Approval . The amount of the guarantee is and will be fully in force for any phase which is being excavated . The estimated cost of rehabilitating each phase must be reviewed by the Department of Public Works . The type of financial guarantee proposed by the applicant under this Section mmust be found acceptable by County Counsel . 2 . DEPARTMENT OF PUBLIC WORKS : Conditions of Approval : a. The excavation plan shall be prepared by a Registered Civil Engineer and include the following: (1) Provide details of the Mokelumne River crossing. Any work in the river shall require San Joaquin County Flood Control District approval, State Reclamation Board Permit, and all other affected agency permits. (2) The final grading plan shall include alternate drainage provisions and final slopes as required by the Environmental Impact Report. At the completion of the excavation operation, provision shall be made to connect the project drainage pond to the existing County (Solari) pond and dedicate the project pond -43-
