product, and has the necessary equipment to respond to a discharge from the vehicle or fuel delivery <br /> hose. <br /> The Shop Superintendent or his designee supervises oil deliveries for all new suppliers, and <br /> periodically observes deliveries for existing, approved suppliers. All loading and unloading of tank <br /> vehicles takes place only in the designated loading rack/unloading area. <br /> Vehicle filling operations are performed by facility personnel trained in proper discharge <br /> prevention procedures. The truck driver or facility personnel remain with the vehicle at all times while <br /> fuel is being transferred. Transfer operations are performed according to the minimum procedures <br /> outlined in Table 5. This table is also posted next to the loading/unloading point. <br /> The level in the waste oil tank is monitored every two weeks. The tank is emptied every three <br /> months, or earlier if it is approximately half full before that time. <br /> H. Brittle Fracture Evaluation (40 CFR 112.7(1)) <br /> No field-constructed aboveground containers are present at the facility, and brittle fracture evaluation <br /> procedures are not applicable. <br /> I. Conformance with State Requirements (40 CFR 112.7(j)) <br /> A facility is subject to the California Aboveground Storage Tank regulations (Health and Safety Code <br /> §§25270-25270.13) if it is: subject to regulation under 40 CFR 112 (Federal oil spill regulations) or has a <br /> storage capacity equal to or greater than 10,000 gallons of petroleum. The Aboveground Petroleum Storage Act <br /> requires that file a storage statement, pay a facility fee every year to the San Joaquin County Environmental <br /> Health Department, and prepare and implement a federal SPCC plan. The facility fee for facilities that store <br /> 10,000 to 100,000 gallons of oil is $675.
