According to Board records, the last monitoring report <br /> received from your facility was submitted for the third quarter 2000. Therefore, the fourth quarter 2000, <br /> first and second quarter 2001 reports are past due. Additionally, WDR Order Number 97-204 required <br /> submittal of a final closure report by 15 October 1999. In response to a report titled Confirmation <br /> Sampling, Removal of Spent Lime Ponds, Former Spreckels Sugar Plant No. 2 submitted on 25 October <br /> 2000, Board staff outlined the requirements of a complete final closure report for your facility and <br /> requested submittal by 1 February 2001. This final closure report has not been received. Non-submittal <br /> of monitoring and closure reports is a violation of Waste Discharge Requirements. <br /> Therefore, pursuant to Section 13267 of the Porter Cologne Water Qualiiy Control Act, you are required <br /> to furnish under penalty of perjury the third quarter 2001 Monitoring Report no later than 15 October <br /> 2001 and a complete final Closure Plan for the former Spreckels Sugar Plant by 15 November 2001. <br /> Pursuant to Section 13268 of the Porter Cologne Water Quality Control Act, any person failing or <br /> refusing to furnish technical or monitoring program reports as required may be liable civilly.
