The following is an itemized list of hazardous waste violations that have not been addressed for LOPEZ CUSTOM COMPOSITES as of January08 , 2020 . Open violations from November 22, 2019 inspection Violation #102 - Failed to determine if a waste is a hazardous waste . OBSERVATIONS -Spent paint booth filters are being disposed of into the trash without first making a hazardous waste determination . - Five 1 gallon metal containers of samples ( Stonecast) were observed in the hazardous waste storage area . Per Noe Lopez ( Owner) he needs to decide if they will be used or disposed of. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations ( CCR ) . There are wastes that are listed as hazardous wastes . There are wastes that exhibit one or more of the hazardous waste characteristics : toxic , corrosive , reactive or ignitable . CORRECTIVE ACTION : Immediately stop disposing of paint booth filters to the trash , make a hazardous waste determination for the paint booth filters & samples and manage it according to Title 22 CCR . Use Safety Data Sheets (SDS ) , waste sampling and test results or other knowledge to support your hazardous waste determination . Waste testing must be done using methods specified in Title 22 CCR including sections 66261 . 20-24 . Submit a statement and supporting documentation with your hazardous waste determination . Demonstrate current storage and labeling for wastes determined to be hazardous wastes . Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status . ❑ This violation was corrected ❑ This violation will be corrected by (date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #106 - Failed to train employees on waste handling and emergency procedures . OBSERVATION: At the time of inspection , it could not be demonstrated ( not necessarily documented ) that employees who handle hazardous waste were properly trained . Per Noe Lopez ( Owner) employees have not be trained on hazardous communication since 2017 . REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper waste handling and emergency procedures , relevant to their responsibilities during normal facility operations and emergencies . CORRECTIVE ACTION : Immediately train the employees .
