OF USE PERMIT APPLICATION NO. UP-92-12 (DISTRICT 5) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors deny the appeal of Conditions 1.k. and 3.a., delete Condition 3.b., and <br /> uphold the Planning Commission's action to Approve Use Permit No. UP-92-12 with the Conditions of <br /> Approval in the staff report, as revised. <br /> REASON FOR RECOMMENDATION <br /> On October 1, 1992, the Planning Commission held a public hearing on this item. Dan Van Groningen, <br /> the applicant, spoke in favor of the project. No one spoke in opposition. After considering all testimony, <br /> the Commission approved the item by a vote of 6-0. On October 9, 1992, Dan and Pat Van Groningen <br /> appealed the Planning Commission's action regarding Conditions 1.k., 3.a. and 3.b. to the Board of <br /> Supervisors. <br /> Appeal Statement No. 1 (Condition 1.k.) <br /> The applicants object to the requirement for engineered plans providing for a storm drainage pond. The <br /> facility has operated without a pond and they don't believe one is necessary. <br /> Response <br /> Condition 1.k. requires that an engineered pond be provided for any additional runoff caused by the <br /> project. The standard condition for all commercial projects that do not have terminal drainage is that all <br /> drainage shall be retained on-site. The facility has been operating illegally without a Use Permit from the <br /> County and also without approved drainage. <br /> Appeal Statement No. 2 (Condition 3.a.) <br /> The applicants object to the requirement for a septic system since they would rather provide portable <br /> handicap restrooms. <br /> BOS LETTER PAGE 1 <br />
