OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM)016467187JJK(dated 9/7/2017)and 020421477JJK(dated 8/1/2019). REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 days. This is a repeat violation, Class II. 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. OBSERVATION: Bills of lading for the recycling of lead acid batteries from 7/6/2017-7/6/2020 were not found on site. REGULATION GUIDANCE: (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. CORRECTIVE ACTION: Provide copies of battery core bill of lading records from the past three years and a corrective action statement to the San Joaquin County Environmental Health Department within 30 days.
