Hazelton Avenue <br /> Stockton, CA 95205 <br /> Subject: Notice to Comply, Sims Metal Management <br /> Stockton, CA CERS I.D.# 10183391 <br /> Inspection of July 6, 2020 <br /> Dear Mr.Alaniz <br /> This correspondence constitutes the response of Sims Metal Management(SMM)to <br /> the San Joaquin County, Environmental Health Department(EHD)as the result of an <br /> inspection dated July 06,2020. As required by the Notice to Comply, SIMM has <br /> corrected the Priority Corrective Action violations and has notified the EHD within the <br /> required 30 days. <br /> SIMM takes environmental compliance seriously and appreciates the opportunity to <br /> respond to the concerns of the San Joaquin County, Environmental Health Department. <br /> We make every effort to ensure the safety of our employees, community, and <br /> environment. For your convenience, pertinent portions of the Notice to Comply(NOC) <br /> are reproduced below, along with our responses. The concerns raised in the NOC are <br /> bolded and italicized below. <br /> 1. (Q102) Immediately make a hazardous waste determination for each waste, and <br /> manage it according to Title 22CCR. Use Safety Data Sheets(SDS), waste sampling <br /> and test results or other knowledge to support your hazardous waste determination. <br /> Waste testing must be done using methods specified in Title 22 CCR including <br /> sections 66261.20-24. <br /> Housekeeping has taken place; items have been swept, properly stored and labelled. <br /> Piles of aluminium have been removed. Secondary containment has been cleaned. Please <br /> see attached photo (Exhibit 1). <br /> Third party company that picks up hazardous waste solids is Environmental Logistics based <br /> out of Hayward (3200 Depot Road, Hayward, CA 94545). <br /> Witch hat located at NF area has been replaced. (Exhibit 2) <br /> 2. (Q104)Immediately post the required information at the facility/ Provide a statement <br /> to San Joaquin County Environmental Health Department that the correction is <br /> complete <br /> A complete modified contingency plan was not posted at the facility. <br /> Please see attached photo of posted contingency plan. _(Exhibit 3). <br /> Sims Metal Management <br />
