b. A permit from the State Reclamation Board shall be required. <br /> 3 . Planning Division : <br /> a. The project shall conform to the approved site plan. Any <br /> deviation will require an amended permit . <br /> b. This permit shall become void should the use of the pro- <br /> perty become a nuisance as defined by Section 9-3113 of <br /> the Planning Title . <br /> c . No excavation shall occur within 100• feet of the waterward <br /> toe of the levee . <br /> d. A reclamation plan prepared pursuant to Section 2772 of <br /> the Surface Mining and Reclamation Act shall be submitted <br /> for approval prior to commencing the excavation. <br /> e . Three years from the commencement of excavation, the <br /> applicant shall •submit a report prepared by a registered <br /> civil engineer to document project ' s compliance status <br /> with the approved permit and to identify any adverse off- <br /> site conditions , such as increased downstream flooding, <br /> erosion or bank instability. If the report identifies <br /> conditions of noncompliance or the occurrence of adverse <br /> offsite conditions , the application shall be brought back <br /> to the Planning Commission for possible modification of <br /> permit conditions of approval . <br /> f . Material stockpiled onsite shall be restricted to the sand <br /> removed during the excavation operation . <br /> g. There shall be no on-site stockpiling of unaugmented fly <br /> ash. <br /> h. Any stockpiling of the sand-fly ash mixture shall be <br /> limited to that portion of the concrete slab shown on the <br /> revised Site Plan as "ash/sand mix bin. " <br /> 4 . State Lands Commission : <br /> A dredging permit is required if material is extracted belo4 <br /> the two-foot datum elevation . <br /> 5 . U . S . Army Corns of Engineers : <br /> An application shall be made for a Department of Army permit <br /> under Section 10 of the Rivers and Harbors Act of 1899 . <br /> 6 . California Department of Fish and Game : <br /> a. A Streambed Alteration Agreement shall be required prior <br /> to any excavation activity within the 100-year flood plain. <br />
